Terms of Service

These Terms of Service (the "Terms") govern your access to and use of the gmcrypto.xyz website and all features served from it (collectively, the "Service"), operated by gmcrypto.xyz ("gmcrypto", "we", "us", or "our"). By accessing or using the Service, you agree to be bound by these Terms and by our Privacy Policy. If you do not agree, do not use the Service.

gmcrypto is an independent crypto market intelligence and education platform. It provides AI-assisted daily market briefings, technical analysis, fundamental project research and risk scoring, DeFi tooling and education, and comparison and portfolio assessment tools.

Some features referenced in these Terms are planned but not yet available. Planned features are marked Planned; current features are marked Live where the distinction matters. Terms relating to a planned feature take effect only when that feature is released.

The Service produces analysis, scores, and narratives generated by software, including large language models, applied to public market and on-chain data. This content is general in nature, is produced without knowledge of your personal circumstances, and may be incomplete, delayed, or wrong.

• Risk scores and grades are model outputs, not endorsements or guarantees. Our methodology is published on the methodology page.
• AI briefings and analysis are grounded in our own structured data but can still contain errors or omissions.
• Market data is sourced from third parties and may lag, contain gaps, or be revised.
• Past performance and any published accuracy record do not predict future results.

Nothing on the Service constitutes financial, investment, trading, legal, accounting, or tax advice, a recommendation, a solicitation, or an offer to buy or sell any asset. We are not your broker, adviser, or fiduciary. The Service does not issue buy or sell calls and is not a substitute for professional advice or your own research.

You are solely responsible for evaluating the merits and risks of any decision you make. Crypto assets are highly volatile and you may lose some or all of your capital. Before acting, consider seeking advice from a licensed professional in your jurisdiction.

The Service is analysis and education only. To be explicit:

• We never take custody of, hold, control, or move your crypto assets or funds.
• We never execute, broker, or facilitate any transaction, swap, trade, loan, or transfer on your behalf.
• We never request, accept, or store wallet private keys or seed phrases, and there is no facility anywhere in the Service to provide them. Treat anyone asking for these in our name as fraudulent.
• Where a feature reads a public wallet address you choose to provide, it is used only to read public on-chain information for that feature.

You must be at least 18 years old and legally able to enter into these Terms to use the Service. You are responsible for ensuring that your use of the Service is lawful in your jurisdiction. The Service is not directed at, and may not be used by, any person in a jurisdiction where doing so would be contrary to law or regulation.

Core features of the Service are available without an account. If and when we introduce accounts and a paid tier, the following will apply:

• Sign-in. Accounts use a magic link sent to your email address. You are responsible for keeping access to that email secure and for activity under your account.
• Subscriptions. Paid subscriptions are billed through Stripe on a recurring basis at the price and interval shown at checkout. By subscribing you authorise that recurring charge until you cancel.
• Cancellation. You may cancel at any time; access continues until the end of the current billing period, after which premium features revert to the free tier. Except where required by law, payments already made are non-refundable.
• Price changes. We may change subscription pricing on reasonable notice; changes take effect at your next renewal.
• Trials. If a free trial is offered, it converts to a paid subscription at the end of the trial unless cancelled beforehand.

When using the Service you agree not to:

• Break any law or infringe the rights of others.
• Scrape, harvest, or systematically extract content except through any API we expressly provide and within its limits.
• Overload, disrupt, probe, or attempt to gain unauthorised access to the Service or its infrastructure.
• Reverse engineer or attempt to derive source code, except to the extent this restriction is prohibited by law.
• Resell, redistribute, or commercially exploit the content or scores without our written permission.
• Misrepresent our analysis as a guarantee, a recommendation, or personalised advice.
• Use the Service to develop a competing product by copying our content or scores.

The Service depends on third-party data sources and may embed third-party components, such as a TradingView charting widget, and may link to external sites. We do not control and are not responsible for the accuracy, availability, or content of third-party data, components, or sites, and their inclusion is not an endorsement. Your use of any third-party service is governed by that party's own terms.

The Service, including its design, text, scores, methodologies, and software, is owned by gmcrypto or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your own personal, non-commercial use, subject to these Terms.

Underlying market data remains the property of its respective providers. Trademarks shown on the Service are the property of their owners.

If we offer a public API, your use of it is subject to these Terms and to any published rate limits, quotas, and API-specific terms. We may throttle, suspend, or revoke API access that exceeds its limits, degrades the Service for others, or breaches these Terms. API keys, where issued, are personal to you and must be kept secure.

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, timely, secure, error-free, or that any analysis, score, or data will be accurate or complete. To the maximum extent permitted by law, we disclaim all such warranties.

To the maximum extent permitted by law, gmcrypto and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, or crypto assets, arising out of or related to your use of, or inability to use, the Service, even if advised of the possibility of such damages. This includes any trading or investment loss you incur after relying on the Service.

To the extent any liability cannot be excluded, our total aggregate liability arising out of or related to the Service is limited to the greater of the amount you paid us for the Service in the twelve months before the claim, or one hundred Australian dollars (AUD 100). Nothing in these Terms excludes liability that cannot lawfully be excluded, including certain rights under applicable consumer protection law.

You agree to indemnify and hold harmless gmcrypto and its operators from any claim, loss, liability, or expense, including reasonable legal fees, arising out of your misuse of the Service, your breach of these Terms, or your violation of any law or third-party right.

We are actively building the Service and may add, change, suspend, or remove features at any time, including moving features between the free and paid tiers. We are not liable to you for any change to or discontinuation of any feature.

You may stop using the Service at any time. We may suspend or terminate your access, with or without notice, if you breach these Terms, if required by law, or to protect the Service or other users. Provisions that by their nature should survive termination, including intellectual property, disclaimers, limitation of liability, and indemnity, will survive.

These Terms are governed by the laws of Queensland, Australia, without regard to conflict-of-law rules. You agree to the non-exclusive jurisdiction of the courts of Queensland, Australia, for any dispute, subject to any mandatory rights you have under the law of your place of residence.

We may update these Terms as the Service evolves. When we make material changes we will update the "Last updated" date above and, where appropriate, provide a more prominent notice. Continued use of the Service after a change means you accept the updated Terms.
